Internet Crime / Cyber Crime Solicitors

Cyber crime or internet crime is a comparatively new and developing area of the law, and covers a wide range of offences. Investigations will often be complex and technically challenging, involving the seizure of vast volumes of data by investigating authorities.

These investigations regularly have an international component, as information is shared across numerous jurisdictions. Examples of this are where investigations being carried out in the UK represent part of a wider investigation, involving law enforcement bodies from across the globe such as the FBI in the United States. Investigation techniques in relation to cyber crime are becoming increasingly sophisticated as law enforcement agencies seek to disrupt and prevent this activity, and prosecute those involved.

Finding yourself subject to a cyber crime investigation can be an intimidating experience. It is vital that you have sophisticated and astute legal expertise at hand in order to conduct a robust defence in relation to any charges made against you. The Criminal Defence Solicitors at Wilford Smith have the required skills, knowledge and determination to ruthlessly develop a robust strategy on your behalf, ensuring the best outcome in your case. Call us today to find out how we can help.
What is cyber crime or internet crime?

Cyber crime or internet crime, terms that are often used interchangeably, refers to a range of offences that are facilitated through the use of communications technologies – in most cases computers and the internet. The prevalent use of the internet has resulted in an increased risk that innocent people may have their identities misrepresented. Examples of cyber crime include:

Computer fraud
Identity theft
Computer hacking
Credit card theft
Phishing and malware scams
File-sharing and internet piracy
Online defamation
Cyber stalking

Cyber crime includes offences whereby computers are used as a means of carrying out a particular type of offence. While these offences may not traditionally be seen as forms of cyber crime, the use of communications technologies in facilitating these offences changes the way that these crimes are prosecuted and defended. Fraud, identity theft and stalking are examples of these types of offences.

The National Crime Agency's Cyber Crime Unit is primarily responsible for investigating cyber crime. Offences will normally be prosecuted under the Computer Misuse Act 1990, or under relevant legislation for offences such as fraud or the viewing of indecent images. If you are alleged to have committed one of these offences it is vitally important that you access legal advice from a solicitor with experience in analysing computers and digital information. The Criminal Defence Team at Wilford Smith has specialist skills in processing this type of evidence and presenting it in court.
Piracy

Piracy refers to the stealing or hacking of another person’s property. In relation to modern cyber crime, this often involves digital software or content, such as music or DVDs. In such cases, the copyright and trademark of the rightful owner will be copied and passed off by the pirate as their own. There are a number of trade organisations that act on behalf of owners in pursuit of those carrying out these types of offences, seeking prosecutions with assistance from local authorities’ trading standards departments. In order to conduct an effective defence in respect of piracy charges this requires specialist legal knowledge. The Criminal Defence Solicitors at Wilford Smith have a wealth of experience in defending clients against allegations, charges and prosecutions relating to digital piracy.
