Private prosecution confiscations

A conviction following a private prosecution will result in the same punishment as if the case had been brought by the police or the Crown Prosecution Service (CPS). As such, there is scope for prosecutors to seek a Confiscation Order which, if granted, gives the court the power to confiscate assets that they believe have resulted from criminal activity. Confiscation proceedings are not automatic, and the prosecution will have to apply for the proceedings to be opened and adjourned at the end of the case.
