What are the eligibility criteria for a Tier 5 Temporary Workers Visa?

You will be able to apply for a Tier 5 Temporary Workers Visa if you are coming to the UK to carry out work in one of five specified categories, with each category having its own particular set of eligibility criteria. The UK uses a points-based system for assessing the eligibility of visa applicants. Those applying for a Tier 5 Temporary Workers Visa will have to score 40 points to be eligible, with points being accrued by demonstrating that you hold a valid certificate of sponsorship and that you can support yourself financially during your time in the UK.

To meet the requirement for sponsorship, you will need to show that you have received sponsorship from the UK-based organisation that is going to employ you during your time in the UK. Your sponsor is required to provide you with a certificate of sponsorship, which takes the form of a reference number that includes information about you and the role that you will be performing. Your sponsor must be recognised by the UK Government to be able to issue a certificate of sponsorship.

The categories of Tier 5 Temporary Workers Visa are:

Tier 5 (Temporary Work – Charity Worker) Visa

This type of visa covers those travelling to the UK to carry out unpaid voluntary work for a charity. Holders can remain in the UK for up to 12 months and will be able to claim reasonable reimbursement from their sponsor for expenses accrued as part of their role.

Tier 5 (Temporary Work – Creative and Sporting) Visa

This visa should be applied for by those seeking to travel to the UK to carry out work as a sportsperson or in the creative industries, for example as a dancer, actor or musician. You will be permitted to stay in the UK for up to 12 months to carry out work of the type stated in your certificate of sponsorship.

Tier 5 (Temporary Work – Government Authorised Exchange) Visa

Holders of this visa are entitled to travel to the UK to carry out work experience, to undergo training, to complete an Overseas Government Language Programme, research or fellowship through an approved government-authorised exchange scheme. This type of visa is valid for 24 months.

Tier 5 (Temporary Work – International Agreement) Visa

This type of visa should be applied for by those seeking to carry out work that is covered by international law during their time in the UK, for example for a foreign government or in a diplomatic household.

Tier 5 (Temporary Work – Religious Worker) Visa

You can apply for this type of visa if you are travelling to the UK to carry out religious work, such as preaching or working as part of a religious order. To be eligible, your sponsor will be required to confirm that you are qualified to carry out your role, that you will only work in specified locations, and that they can support you financially during your stay. Holders of Tier 5 (Temporary Work – Religious Worker) Visas can remain in the UK for up to 24 months.
