Purchase of a freehold or leasehold residential property

Our fees cover everything required to complete the purchase of your new home, including dealing with registration at the Land Registry and the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property is in Wales.

Disbursements are costs related to your matter that are payable to third parties, such as:

  • Legal fee
  • Search fees
  • HM Land Registry fee
  • Electronic money transfer fee
  • ID and address verification fee(per person)
  • Stamp Duty Land Tax/Land Transaction Tax

We pay disbursements on your behalf to ensure a smoother process.

Anticipated Disbursements for leasehold properties

In addition to the disbursements mentioned above additional disbursements may apply to individual leases relating to a property, including:

  • Notice of Transfer fee.
  • Notice of Charge fee (if the property is to be mortgaged).
  • Deed of Covenant fee.
  • Certificate of Compliance fee.

The above fees vary from property to property – we can give you an accurate figure once we have had sight of your specific documents

Ground rent and service charge are likely to apply throughout your ownership of the property.

Stamp Duty or Land Tax (on purchase)

This depends on the purchase price of your property and can be calculated using HMRC’s website or the Welsh Revenue Authority’s website (if the property is located in Wales).

Our fee assumes that:

  • This is a standard transaction without any unforeseen matters, such as a defect in title, that requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction.
  • All parties to the transaction are co-operative and there is no unreasonable delay from third parties providing documentation.
  • No indemnity policies are required. Additional disbursements may apply if indemnity policies are required.
  • For a leasehold property, this is the assignment of an existing lease and is not the grant of a new lease.

The length of the purchase depends on a number of factors but we cover all issues from taking your initial instructions to completing the purchase and dealing with the payment of stamp duty or Land Tax and registering the property with the Land Registry.

The average process takes between 8-12 weeks. It can be quicker or slower, depending on the parties in the chain. For example, if you are a first time buyer, purchasing a new build property with a mortgage in principle, it could take 6 weeks. However, if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 3 and 5 months (in such a situation additional charges would apply).

The exact cost will depend on the individual circumstances of the matter and depends on whether various factors exist. All fees include VAT.

We will cover the whole process for the Grant of Probate as part of our comprehensive services.

Disbursements are costs related to your matter that are payable to third parties, such as:

  • Probate application fee.
  • Swearing of the oath (per executor).
  • Bankruptcy-only Land Charges Department searches.
  • Post in The London Gazette.
  • Post in a Local Newspaper.

We pay disbursements on your behalf to ensure a smoother process.

There can be additional costs where:

  • There is no will or the estate consists of any shareholdings (stocks and bonds).
  • If any additional copies of the grant are required.
  • Any sale or transfer of any property in the estate is not included.

The length of time it takes will depend on the factors of the case. Once we obtain the grant of probate, collecting assets then follows, after which we can distribute the assets. On average, non-complex estates are dealt with within 6-9 months.

  • Advice and assistance in relation to a special reasons hearings.
  • Advice or assistance relating to any appeal.

Our fees include VAT unless specifically stated. The exact number of hours it will take depends on the circumstances in your case, such as:

  • The amount of supporting evidence that we need to consider.
  • If anything is missing or needs translating.
  • Which language(s) you speak.
  • Whether you are applying with other dependants.

What services are included

Our fee includes advising you on all your options as well as preparing and submitting any application and attending any Home Office interviews that you need to attend.

Disbursements are costs related to your matter that are payable to third parties, such as:

  • Interpreters fees.
  • Independent expert reports, for example, medical experts.
  • If there is an interview that we need to attend, there will be additional disbursements in respect of our travel expenses.

We pay disbursements on your behalf to ensure a smoother process.
